Most people cannot afford an accident.  We know that.  And, again, we remember that at all times.  Most live a pay check away from missing a mortgage payment or car installment.  We try our level best to get you compensation and get it as fast as fairness allows.  Whether that is battling the insurer for accident benefits or pressing for an early and fair mediated settlement of your long term disability claim – we get on with it. 

We will not ask you to park your life and wait 6 years until it is convenient for us to move the file along. 

They Say It's All In My Head

We’ve heard it all.  It’s in your head.  Every one bounces back.  Just get back to the office, to the night shift at Transcontinental, to nursing at Gateway Haven. 

But as we all know, and as the courts know, some don’t bounce back.  For some it’s not in their head.  Many cannot just pick up a hammer or hit the keyboard and get on with their life. 

On especially the soft tissue injury claims, we work with you and experts to establish your claim and to cause insurers and others to take you and your injuries seriously.

We understand post traumatic stress disorder.  We understand acquire brain injury.  We understand chronic pain.  We get it and we will press for full compensation for these and other ‘invisible’ injuries.

There is no way I can afford to retain a lawyer

Insurance companies, large employers and institutions have deep pockets.  They can be intimidating.  We try to level the field.  We run virtually all of our files on a ‘contingency’ basis. 

This means, quite simply, we are paid fees when you are paid compensation.  Those fees are a percentage of what we collect for you.  In some cases we ask for help with our out of pocket expenses, but this is only where our client can afford to do so. 

If we are unable for whatever reason to collect compensation, there is no fee.  Our retainer agreement spells this out in more detail.  We have a completely transparent fee policy so call or email us with any questions.

We do not shy away from a challenge, whether large or small.  We have accomplished much over the years for our clients – whether routine slip and fall cases or large and complex motor vehicle litigation.  But to give an idea of our style, let us share with you something about two other kinds of cases – one very large and the other literally small claims.

Native Residential School Claims:  Years ago, when almost no lawyers were involved in these claims, I met a survivor of a school on the North Shore.  We accepted her claim.  And her husband’s.  And over 100 other survivors.  We spent several years traveling the North Shore, meeting with clients and hearing their stories.  And we went on to negotiate the first comprehensive settlement of any such claims in Canada.   We got the job done fairly and expeditiously.  We’re proud of it. 

The burning pickup:  One client returned from a party to find his pickup in flames.  The insurer refused to pay on the basis that alcohol was a factor.  We sued.  Despite no evidence to back them up, the trial court agreed with the insurer.  We appealed.  The Divisional Court agreed with us.  The insurer appealed from that.  We stuck it out and a year later, the Ontario Court of Appeal sided with our client as well.  Total value of the claim:  A paltry $3,000.00 for his 1978 truck.  But it was a matter of principal and we did not let it go.

For those left with a head injury, a pelvic fracture or fibromyalgia, it is a real accomplishment to get through the day.  For those who have been abused in their childhood, the depression is crippling.
